say hello to the Fresh and New Philippine DRM law ala RA8293
« on: February 14, 2013, 02:31:48 am »
Congress has just passed a law erasing this right. The law — a consolidated measure amending RA 8293, was sent to Malacañang Palace on January 29, 2013 and just needs the signature of President Benigno Aquino III to become effective. Under this new law, once you modify a device (for instance “jailbreaking” an Apple product such as an iPhone or iPad) in order to remove restrictions on what and how apps and content can be stored and used — you can be held criminally liable for ”copyright infringement.” The amended version introduces for the first time in our criminal law the concept of “digital rights management” (DRM) – which also covers how we use digital devices on the Internet and which behaviors are considered criminal.

All this does is hindering development, specially in this 3rd world country.. iba talaga ang bilis ng proseso pag may nagbabacking na malalaking kompanya.

I am referring to the Data Privacy Law (RA10173). The provisions seem innocent looking pero if you really study the implications, ang higpit nito. May parusa sa sinuman mag reveal ng any personal info about any person without the person's consent. So pag nag post ka ng pic ni Katrina Halili at di nya alam ito, you are liable under the law. The online community should start a move to have this law repealed soonest.

This amendment is unconstitutional.  What is protected by copyright is the unlawful duplication and distribution of copyrighted materials.  Here, if I buy an Iphone, ownership is transferred to me from the time of delivery.  Save for illegal duplication and duplication, I  can do whatever I want with the phone since it is an attribute of ownership.  I can break it, throw it, modify it and even repaint it.  By doing so i could not be held liable since no copyright was violated.   With the passage of this amendment, it virtually makes an owner liable if he breaks his phone.  It is therefore an unlawful taking of personal property without due process of law.

pwede!

its not the issue of OPEN LINE/SIM UNLOCKING

its the issue of circumventing the security protocols placed by the Manufacturer of the electronic device to install applications and transferring multimedia outside the intended protocols

Unconstitutional? i dont thinks so, BULLSHIT? yep it is

Software and multimedia are protected under Intellectual Property laws, we can buy APPs/Games, Songs, Videos/Movies and Literature BUT WE DO NOT OWN THEM, they are still owned by whoever published them, we simply PAYED for the right to have copies and use them as we see fit except duplication and profit by selling or sharing with other people

we are also NOT ALLOWED to modify an electronic device to use the device in a manner other than what the manufacturer intended it for, so if the manufacturer declares their product can only install applications or download multimedia in a SPECIFIC WAY (I.E. from a specific source such as a dedicated repository of applications and multimedia) modifying to circumvent this is technically illegal

the Hardware and Software/OS of Electronics are BELONG to the PATENT owners, we simply BUY the RIGHT to USE their products and we do not have the right to modify them to bypass security measures preventing applications and multimedia to by placed and used in their products outside the accepted protocols

Well this sucks.

Approving the law is one step...Implementing it may be doubly difficult though...

NOTHING will happen to this law.
