MANILA - A lawyer on Friday urged the government to order the recall of allegedly defective Montero Sport units, citing accidents abroad involving the vehicle of Mitsubishi Motors Corporation (MMC).
Speaking to radio dzMM, Atty. Rita Linda Jimeno said accidents rooted in Montero's "sudden unintended acceleration" (SUA) have been recorded in New Zealand and Australia.
Jimeno said the car model's unintended acceleration also killed several people in Israel.
The lawyer also shared that when she first represented Montero owners in SUA complaints in 2012, United Kingdom-based electrical engineer Dr. Anthony Anderson contacted her to offer his expert opinion on the accidents.
Anderson, who has served as expert witness to SUA complaints in New Zealand and Australia, said studies show that unmanned acceleration incidents may be caused by a glitch in the electronic sensors used in controlling the car engine.
"Napag-aralan niya (Anderson) na ang posibleng dahilan daw ay mayroong defect doon sa electronic sensor kapag nagsa-start ang engine. Iyang electronic sensor na iyan, binabasa niya kung time na para umandar," Jimeno quoted Anderson's explanation.
"Pero kapag medyo mahina raw ang battery ng sasakyan, it's possible na magkakaroon ng misreading or mako-confuse iyung sensor na iyun kaya magre-rev up ang engine to make up for the lack of power, dahil napakalaking power ang kailangan para i-start ang engine, kaya biglang mag-a-accelerate."
The glitch causes the vehicle to race off by itself, with the driver unable to bring the vehicle to a halt using the brakes.
The lawyer said Anderson has suggested the recall of the car model and for the manufacturer to install a safety mechanism that will prevent unintended acceleration.
Jimeno urged the Department of Trade and Industry (DTI) to invite Anderson to its hearings on the alleged defect. She said the electrical engineer is willing to fly to the Philippines to shed light on SUA cases.
She added that her clients are unsatisfied with the claim of MMC Philippines that attributes SUA incidents to "driver's error."
"Talagang ang mga kliyente namin, galit na galit sila dahil karamihan ang tagal nang nagmamaneho. Tapos kapag inisip natin statistically, kapani-paniwala ba naman na iyung mga nagda-drive ng Montero, sila lang ang hindi marunong tapos iyung mga ibang sasakyang dina-drive, okay naman. Paano nangyari iyun?" she said.
Jimeno urged the Department of Trade and Industry (DTI) to invite Anderson to its hearings on the alleged defect. She said the electrical engineer is willing to fly to the Philippines to shed light on SUA cases.
Jimeno said the government could also summon an earlier batch of complainants against the allegedly defective Montero in 2012.
The lawyer is confident that the court can ask for the testimony of her old clients despite a confidentiality agreement they signed with MMC in exchange for financial settlement.
"Kapag po sini-settle ng Montero ang kaso, pinapipirma po sila ng confidentiality agreement na hindi nila pwedeng i-divulge o i-report ang settlement na nangyari. Noong piniramahan po iyun, ang mga tao siyempre kinakailangan nila iyung pera para makabili ng bagong sasakyan," she said.
"Sa legal opinion ko lang, kung kinakailangan silang pagsalitain ngayon dahil involved na ang public interest at under duress naman nilang pinirmahan iyun, sa tingin ko papayagan naman ng hukuman at hindi sila naman matatawag na lumabag sa compromise agreement na iyun."
DTI did not allow the earlier batch of complainants to file a class suit against MMC, Jimeno said.
COVER-UPS?
In Japan, Mitsubishi Motors was previously under fire for alleged vehicle defect cover-ups.
A Japan Times article said that in 2000, Mitsubishi Motors Corp. (MMC) President Katsuhiko Kawasoe resigned amid criticism of the firm’s concealment of customer complaints.
The article, citing investigative sources, said workers at MMC plants in Kawasaki and Okazaki, Aichi Prefecture, secretly repaired defective vehicles that should have been recalled by MMC headquarters.
The Japanese publication also reported another defect scandal in 2004 for MMC's concealment of design flaws in parts for its large vehicles which resulted in a series of accidents, one of them fatal.
Mitsubishi Motors Philippines, meanwhile, has assured the public that the Montero Sport is not defective and is safe.
The firm earlier said it already conducted tests and investigation with MMC to determine the cause of the alleged unintended acceleration.
The company said it "has not found any defects or cause directly linked to the vehicles involved."
