TS sabhin mo sa friend mo mag file ng complaint dalhin yung pekeng papers as physical evidence as of the car sa totoo lang bawal isangla ang isang kotse if its still under mortgage plan meaning sinangla yan under the table, kung kanino man naka register ang car yun ang hahabulin ng banko. wala ka magagawa but to surrender the car kasi technicaly hindi sa friend mo ang kotse. she/he has to give it up. tell your friend to hire lawyer kasi ang hahabulin nyo eh yung kabigan nya at hindi yung banko.

The remedy he could do is to go after his friend by filing a criminal complaint for OTHER FORMS OF SWINDLING (Par. 1 Art. 316 Revised Penal Code) before the Prosecutor's Office. He cannot retain the motor vehicle by himself since he is not the owner and the purported mortgage is spurious. Thus, it is best to surrender the same to the Sheriff if the latter can validly show a writ of possession. In order to save cost, you may go to the Public Attorney's Office to help you prepare the Affidavit-Complaint and the address should be the "last known address", regardless if his friend still resides in the said place.

yung procedure ang pagtanong niya sa mga abogado. kasi kung financing company yan, malamang may annotation sa rehistro niyan na totoo. binding yun sa kanya, ala siya depensa don.

kung peke papers, pede estafa yan.
pero wag na niya probllemahin yon, tutulungan naman siya pag gawa ng affidavit e.

When you prepare a complaint, the designation of the offense is not important. It is in the allegations embodied in the body of the complaint that the fiscal determines what case is to be filed in the court. Based on the facts given, there is deceit or fraud employed. So most likely, there is Estafa.

When there is a sheriff involved, presumably the case filed is Recovery of Possession for that motor vehicle by the financing institution. The defendant in that case is the friend of your friend. Since, the subject motor vehicle is in your friend's possession, the Sheriff may get it from him by virtue of the writ (Assuming there is already a decision in favor of the financing institution). If your friend will not surrender it to the Sheriff, he may be held liable for contempt of court or the financing institution may institute a case for carnapping against him.

He cannot do anything against the financing institution for that motor vehicle in his possession since technically, he is not the owner thereof. The only recourse is to go after his friend and file the necessary criminal charges against him.

The Sheriff may show to him the Decision of the Court and/or Writ of Replevin. He cannot be charge  unless he refuses to surrender the motor vehicle despite showing the valid documents to him by the Sheriff. Upon surrendering the unit, he need not seek the services of a lawyer unless he wanted to. In filing a case against the person who defrauded him, he may go to the PAO for assistance or he can even ask the Police Station to assist him in making a complaint.
