Contrary to the announcement of Supreme Court Spokesman Midas Marquez that the High Court voted 8-5 reiterating the temporary restraining order on the Watch List Order of Justice Secretary Leila de Lima issued on former President Gloria Arroyo and her husband, a highly reliable source said the tribunal, voting 7-6, actually declared its Nov. 15 TRO inoperative following the failure of the Arroyo camp to comply with all the conditions set by the court.

Ang alam ko magkaiba ung case presented. Ung TRO na tinutukoy nila na naaprubhan sa en banc ng SC is for the issue against the DOJ Circular #41 na nagbibgay kapangyarihan sa DOJ na maglabas ng HDO para sa mga taong may kinkaharap na pending investigations or case. Samantalang ung isa naman is talagang HDO kasi may outstanding warrant of arrest sya for the "Election Sabotage /Fraud" na sinampa sa kanya sa RTC branch lang. Kaya sinabi nila na moot and academic un kasi obviously may mananaig ngaun ung HDO para dun sa inisyu na warrant of arrst.

All SC versions reported by Midas are "correct."  Problem yung article misleading.  Nadala ng starting word na "contrary" and disregarded legal events and triggers in between.

Medyo disappointed ako sa Vera Files...  I hope Yahoo will just source their news from any local leading daily.

its quite clear that the TRO of mrs. gma is not effective anymore because of the warrant of arrest given by regional trial court yan ang klaro hinde pede makalakbay ang isang tao kun may warrant of arrest but in the case of  FG mike the TRO is still valid pede cya lumabas ng bansa....circullar 41 and the electoral sabotage is a different case yun lang ka simple para maintidihan ng simple tao dont make it complicated.....

Yan ang mahirap sa atin, masyado tayong nagpapaniwala sa kung sino sino, may facts na mas pinapanigan pa ang chismis kasi ang chismis may drama, haaay wala talaga tayong pag asang umasenso pa ganito tayo ng ganito. Common sense lang mga kapatid meron pa bang mas highly reliable source sa mga supreme court rulings kesa sa supreme court appointed spokesperson?  Alam ko tao lang si Atty. Midas Marquez at maaring magkamali, sa palagay nyo kaya di sya icocorrect ng mga supreme court justices sa mga pagkakataong magkamali sya ng pronouncement? 

Alam ko na maraming duda sa ating  Supreme Court ngayon dahil most of the justices are Arroyo appointee, pero yun ang reality and we have to accept it.  Hindi natin dapat payagan na manaig ang pagdududa sa kataastaasang hukuman kasi tayo din ang talo sa huli, ang dapat nating gawin ay palakasin ang mga institusyon tulad ng supreme court at kumilos ng naaayon sa batas at bigyan ng oportunidad ang ating mga mahistrado na gawin ang kanilang mga trabaho ng tama ng walang bahid ng pulitika at pagdududa.

Tandaan natin na ang kabiguan ng Administrasyon ni Pnoy ay ating kabiguan din, ang kabiguan ng Supreme Court ay ating kabiguan din, ang kabiguan ng kahit na anumang institusyon ng gobyerno ay ating kabiguan din.  Kaya sa huli tayo ang syang tunay na kawawa.

well, if you read the article clearly, it states that the report was based on a "source", not from the supreme court itself or from Midas Marquez. the court's stand with the TRO is the same, it is valid and effective immediately. later that day, the scope of the TRO changed, since CGMA already has a standing warrant of arrest; CGMA can no longer travel abroad. but her husband and other persons covered by the TRO still can go. there is no contradiction with their stand.

Ang pagkakaintindi ko, ang TRO ay ang pagpigil sa pagpapatupad ng pagpigil sa pagalis ng bansa ni Ms. Glorya.  Nag issue ng TRO ang SC upang pigilan ang DOJ sa pagpigil kay Ms. Glorya na umalis ng bansa dahil sa panahon ng pangyayari na yun, wala pang nakasampa na kaso sa kanya.  Apektado dito ang lahat lalong lalo na ang mga umaalis ng bansa tulad ng mga OFW.  Wala makakapigil sa inyo sa airport na umalis kun walang HDO na inilabas ang anumang hukuman. Maari nyo kasuhan ang mga empleyado ng airport na pipigil sa inyo sa pag alis.

However, may supervening events na nangyari. Nagkaroon na sya ng arrest warrant.  Now, maski may arrest warrant ka, kailangan pa rin mag declare ang korte ng HDO.  Hindi nangangahulugan na may arrest warrant ka eh meron ka na rin HDO.  Marami tao ang may arrest warrant na gagala gala lang din.  Pag nahuli ka at makapag lagak ng bail, maari ka pa rin umalis ng Pilipinas kun di ka pa rin napailalim sa HDO. Hangga't walang declaration ang korte ng HDO, she can evade arrest and leave.  But being a public figure, I do not think she will do that.

oo nga only in the philippines, only in the philippines na hindi nirerespeto ang KORTE SUPREMA. marami na nganng krisis may economic krisis, may krisis sa pagkain, krisis sa kuryente ngayon may bago nanamang constitutional crisis.hay naku yung tuwid na daan nilagyan naging fly-over na.

While the Supreme Court upheld on Friday its temporary restraining order (TRO) on the government’s inclusion of former President Gloria Macapagal-Arroyo and her husband Jose Miguel “Mike” Arroyo in the immigration watch list, the TRO was not really effective yet because one of its conditions was not met.

In a press conference on Friday, Marquez announced the high court’s rejection of the executive branch’s appeal to reconsider the issuance of the TRO and said it “remained in full force and effect.”
