it doesnt even have to reach to him winning the presidency again..the mere fact that the COMELEC approves him to run (if they approve him) will be a mockery to us all Filipinos. MasterChief63 said it well:

if you could remember, naka-state sa pardon nya na "cannot run to any public office again", so legally hindi na siya pede ulet tumakbo ng kahit anong posisyon sa gobyerno. if ever na payagan siya tumakbo ulet, that means, bale wala lahat ng nangyari nung edsa 2, and just like master chief said, it proves the insults.

ang sa akin, tatakbo at tatakbo yan, wala namang problema kapag kinusap ka ni ninoy aquino, josefa llanes escoda, Chief Justice Jose Abad Santos, Brigade General Vicente Lim  manuel roxas, manuel quezon, sergio osmeña...malamang sa lamang kapag ito ang mga kumausap sa mga botante iboboto nila yang mga iyan...

Erap is going to run for president and has a strong possibility to win again but will he be able to sit again as president is going to be the issue that will polarize our countrymen because the extremists (right and left) will not allow Erap to sit again as president so let's hope that our polarization will not be bloody.

ang kapal talaga ni Erap. Literally "walang-hiya". Dapat sa kanya manahimik nalang sa bahay with his grandchildren. Pasalamat nalang siya that he's a free man. Ang nakakainis din ang mga masses na tuwang tuwa everytime he visits some barangays etc, grabe pa rin ang reception niya. You'd expect them to boo him or throw stuff at him. Ang bilis makalimot ng mga Pinoy.

the biggest question is: DID ERAP RESIGNED AS PRESIDENT? He did not resigned as being mentioned by the dwarf president.. he only left Malacañang Palace BUT never resigned as the President of the Philippines..

di na dapat sya tumakbo, at hindi n rin sya dapat manalo, mangmang lang ang gugustuhing mamuno ulit ang napatanuyan ng mandarambong at sindikatong si erap, sayang hirap nating nag-alis sa kanya sa puwesto nung edsa2.

damn PGMA's decision of pardoning him (note: not executive clemency), and tama ung bro nating nagsabing ang kapal ng mukha niya at ng kanyang mga alipures.

legally and morally, he is not fit to run, and should not win. categorically, he can't or won't help in improving the lives of our people. peace!

saka sa tingin ko, in order for erap to sit as president, the only way is for him to run as Vice-President, then wait for the president to die, resign, be removed with cause (think impeachment), or be incapacitated to perform the functions as president.

other than succession, di sya pwede ma re-elect as president.

1. Is Pres.Arroyo is a legitimate president? Why.

Yes. As decided by the court of last resort, President Arroyo is LEGITIMATE president as a successor of former Pres.Estrada. The Supreme Court foreseen the case as a matter of national security and national integrity. Estrada did not resign from the office but the mere fact that he left Malacañang Palace and the political crisis that Estrada faced that time, the court of last resort ruled that if no one will took the presidency, much more crisis will arise and as a provision in 1987 constitution (article 7, section 8), the vice-president will be the ACTING PRESIDENT. Pres.Arroyo took place the presidency only as a SUCCESSOR to the vacant seat of the president.

2. Is former Pres.Estrada can run for president on May 2010? Why.

In general, the answer is clear (article 7, section 4), No. Former Pres.Estrada is ineligible to run for president on May 2010. But if I were to analyzed the provisions of the constitution, as stated in article 7, section 4.

"The President and the Vice-President shall be elected by direct vote of the people for a term of six years which shall begin at noon on the thirtieth day of June next following the day of the election and shall end at noon of the same date, six years thereafter. The President shall not be eligible for any re-election. No person who has succeeded as President and has served as such for more than four years shall be qualified for election to the same office at any time".

The bold letters: The term president is a confusion to whom it may be applied. Whose president? Is it Ramos, Estrada, Aquino, Marcos, or Arroyo?

Italicized letters: "No person who has succeeded as president". Did former Pres.Estrada succeeded his term? I presume you know the answer.

"has served as such for more than four years shall be qualified for election to the same office at any time". Did former Pres.Estrada served more than four years? I also presume you know the answer. Therefore, "shall be qualified for election to the same at any time".
