Biazon: Rebellion raps a way out for Ampatuans?

MANILA, Philippines -- Senator Rodolfo Biazon is seeing a ``sinister plot'' behind the move of the government to file rebellion charges against several members of the Ampatuans who had been charged for the Nov. 23 slaughter of 57 people in Maguindanao.
While the rebellion case could be the government’s way of justifying its imposition of martial law in the province, Biazon said on Sunday the rebellion case would also absorb the cases of multiple murders against the Ampatuans.
This would provide the Ampatuans a possible ``escape route'' from direct responsibility for the mass murders, Biazon told the Philippine Daily Inquirer.
In a phone interview, the former Armed Forces chief of staff said that Malacañang was preparing to file rebellion charges against the Ampatuans because it lacked factual basis for imposing martial law in Maguindanao.
Under the Constitution, martial law could only be declared by the President amid rebellion or invasion, Biazon pointed out.
``But I see a more sinister plot in filing rebellion versus the Ampatuans. Because murder, arson and other serious crimes may be absorbed in the crime of rebellion,'' he said.
But he said rebellion as a crime was ``hard to prove'' and that those charged with it could be given amnesty.
``So is this (filing of rebellion charges) a first step to absolve the Ampatuans of the mass murder?'' the senator asked.
He said it was possible Malacañang was providing a ``way out'' or ``opening the door for the Ampatuans to find an escape route from the responsibility of the mass murders.''
Biazon also said he did not see the need to declare martial law in the province because the country had `sufficient'' laws as well as law enforcement agencies ``to arrest, investigate and prosecute those responsible for the massacre.''
Biazon added he could not accept the explanation of military officials about a looming rebellion, just on the basis of their sightings of armed men in the province.
He pointed to many armed groups sighted in Bicol, Samar and Antique, apparently in reference to the communist New People's Army.
``Will you declare martial law because of these sightings too?'' he asked.
