The person who's updating FAD right now goes by the name of Thegreatest.
Thegreatest is not one of the owners of the website. He is a regular contributor to FAD, and in November of 2008, Mike (the name of FAD's owner, or at least his online name) gave Thegreatest posting access to help with the maintenance of the site.
As Thegreatest did say in FAD's latest update, "I’m wishing for the best for Mike and will try to keep the site updated until I hear from him."

Either of two reasons, or perhaps both:
1. The NBI won't be able to trace him. He doesn't own the website. The registration details do not point to his address. His IP address, like most IP addresses in the Philippines, is most probably dynamic and shared by hundreds of households. Thegreatest can post whatever he wants and the NBI won't have a clue on how to trace him, save for torturing the FAD owners in their custody into revealing Thegreatest's real identity.
2. The NBI is logistically and intellectually flawed, and this entire situation will lead nowhere anyway. First, did the NBI raid the FAD owner's house on the strength of a valid warrant? Second, the only possible case that can be filed against the FAD owners is violation of RA 9262, particularly Sec. 3, par. D of the said law. However, such a case will be weak at best, mainly because of lack of precedents involving "acts or omissions causing or likely to cause mental or emotional suffering of the victim" committed over the, eherm, internet. Trust when I say this: most judges don't even know what the internet is. It's true. Ask any law student who has a judge or a retired justice for a teacher. Those old blokes still think that xerox machines are God's greatest creations and they pine for the time when students copied voluminous pages of text with their hands.
So, will FAD continue?
Let's take a look at how FAD works. The porn we see there don't come from the FAD owners. They come from the visitors who contribute their shit to the said website.
It's just like Espiya.net. The shit in this website don't come from the owner, SG. SG just sits in front of his monitor with a tissue at hand at all times. The shit in this website comes from members like you and me, contributing our finds for other members to enjoy.
That's how FAD works. The FAD owners merely collate the contributions and posts them via blog entries.
FAD owners may be gone, but Thegreatest is still there to collate, and hopefully update, the website.
The problem is, when the FAD owners do come back to their home, they might decide to go clean to avoid complications like their recent escapade with the NBI. Since FAD has been associated with them and their family name, they might decide to just shut it down themselves.
Not to worry, though. When God closes a door, He opens a window.
Even if it's a window to a lot of naked ladies.
